Terms of Service

Welcome to Munai. These Terms of Service ("Terms") govern your access to and use of the Munai marketing automation platform, including our website, automated SMS and email services, lead capture tools, and payment processing integrations (collectively, the "Services").

By accessing or using Munai, you agree to be bound by these Terms. If you are using the Services on behalf of a local business or organization, you represent that you have the authority to bind that entity to these Terms.

Munai provides an SMS first marketing and lead management platform built for local service businesses. Our platform includes lead capture through forms, a website chatbot, and an SMS Agent; automated review requests, including QR review automation; follow up emails; payment links through Stripe Connect; a website tracking script with visitor stats; Google Business Profile sync; and, on eligible plans, missed call SMS and call tracking.

To access certain features of the Services, you must register for an account. You agree to:

• Provide accurate and complete information during registration.
• Maintain the security of your password and accept all risks of unauthorized access.
• Notify Munai immediately if you discover any security breaches related to the Services.

Munai uses automated SMS and email workflows to engage with your customers. You acknowledge and agree that:

• You are responsible for obtaining clear consent, or opt in, from your customers before any automated messages are sent through Munai.
• You must comply with all applicable laws and rules governing commercial communications, including the TCPA, CAN SPAM for email, and carrier requirements such as A2P 10DLC registration for business messaging.
• Munai may suspend or restrict accounts that generate high spam complaints or violate carrier guidelines.

Munai integrates with Stripe Connect to provide payment links. All transactions are governed by Stripe's Services Agreement. Munai is not a bank or payment processor and is not responsible for the success or failure of transactions between you and your customers.

Our platform automates sending review requests to your customers. Munai only delivers these requests; it does not write, generate, or post reviews on your behalf. You agree not to use this feature to solicit fraudulent reviews, to incentivize reviews in violation of a platform's terms such as Google or Yelp, or to contact customers who have opted out of communications.

Munai is a subscription service billed monthly in advance. New accounts start with a free 10 day trial; if you do not select a paid plan, your access ends when the trial expires. Fees are not refundable except where required by law. We may change our pricing with thirty days notice. Some plans include usage limits and optional add ons, such as additional team members, which are billed as described at signup.

To the maximum extent permitted by law, Munai shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use our automation tools, including lost profits or loss of data.

You may cancel your account at any time through your dashboard. Munai reserves the right to terminate or suspend your access to the Services without prior notice for conduct that we believe violates these Terms or is harmful to other users of the Services, us, or third parties.
